Employment

Richard is regularly instructed for multi-day hearings in all areas of employment and discrimination law. He is experienced in appearing for  Claimants and Respondents before Employment Tribunals in England and Scotland . Richard also has appellate experience in the Employment Appeal Tribunal and the Court of Appeal. His practice covers unfair and wrongful dismissal, discrimination, equal pay, protected disclosures and TUPE. Richard regularly provides advice on all aspects of employment law and is experienced in drafting pleadings.

Business

Richard’s practice covers all forms of consumer and commercial contracts, including sale of goods. He accepts instructions in relation to company and partnership law, including directors' duties and shareholder disputes. He is experienced in relation to PPI claims.

Insolvency

Richard regularly deals with Insolvency matters covering all aspects of corporate and personal Insolvency including litigation. Richard deals with bankruptcies, voluntary arrangements, administrations, liquidations and all forms of petitions and applications. Richard is member of R3 - the Association of Business Recovery Professionals and regularly attends their regional events.

Chancery

Richard accepts instructions in all areas of landlord and tenant; residential, commercial and agricultural. He deals with possession proceedings and Anti-Social Behaviour Injunctions applications/breaches. His property work includes housing disputes, easements, rights of way, boundary disputes and covenants. Richard is also instructed in probate and trust matters including Inheritance claims.

Administrative & Public Law

Richard has received instructions in commercial Judicial Review proceedings.

Mediation

Richard is an ADR Group Accredited Civil and Commercial Mediator and is available to act as a mediator and represent those involved in mediations. Trinity Chambers has facilities to undertake mediations.

Cases:

Brownbill v St Helens & Knowsley Hospitals NHS Trust, CA [2012] ICR 68 and EAT [2010] ICR 1383

Appeared successfully at the Employment Appeal Tribunal and overturned a decision that unsociable hour enhancements did not represent a separate, less favourable term for the purposes of an Equal Pay Act 1970 comparison and subsequently succeeded in having that decision upheld in the Court of Appeal.

Emmanuel v City & Hackney Teaching PCT & Secretary of State (2011)

Appeared for Claimant in 6 week test case GMF hearing regarding NHS claims.

Gutridge v Sodexo (2007)

Appeared successfully for Claimant in first instance decision on whether TUPE transfer starts time running for an equal pay claim and whether transferor/transferee liable for remedy. Case subsequently heard in Court of Appeal, providing principal guidance in this area – [2009] EWCA Civ 729.

Kryg v Sunlight Service Group (unreported 2007)

Successful appearance for Respondent in multi-day race discrimination, protected disclosure, unfair dismissal and breach of contract case.

Fowler & Others v Glasgow City Council

Appeared for Claimant in 4 week GMF hearing.

McCrory v Royal Mail [2010] EqLR 399

Successful claim for indirect sex discrimination in case where single parent female Claimant had her flexible working request for shifts that avoided Saturday working refused despite child care difficulties on weekends.
