A Guide to the Quincecare Duty - Simon Goldberg K.C.

At Trinity’s 2022 Commercial Litigation Conference held in Leeds, Head of Chambers’ Business and Property team, Simon Goldberg K.C. delivered a session entitled:
‘Banker Beware’ - A Guide to the Quincecare Duty.

In the session, Simon details the ‘Quincecare Duty’ owed by banks. Simon discusses the key Court decisions which analyse the scope and application in differing scenarios of the duty requiring banks to refrain from executing an order when, on inquiry, the order would result in the misappropriation of funds.

His topic covers the following:

- RBS v JP SCP 4
- Federal Republic of Nigeria v JP Morgan
