Building Act Injunction Success for Trinity Silk & Barrister

Members of Trinity Chambers' Business and Property team, Silk Simon Goldberg K.C. and barrister Seth Kitson, have successfully secured the partial demolition of a six story block of flats in the centre of Kettering, following a two day hearing at the Birmingham Technology and Construction Court.

In North Northamptonshire Council v Michigan Construction Ltd, the High Court ordered the partial demolition of the site known as Job’s Yard, Kettering.

Instructed by North Northamptonshire Council, the Trinity team is pursuing an injunction under Section 36(6) of the Building Act 1984. The case appears to be the first High Court case to consider the application of that provision.

Following the conclusion of the hearing, the Defendant Developer has been given a strict timescale to effect the partial demolition of the building, failing which the matter will return to the High Court to consider the total demolition of the site.
