Head of Trinity's Licensing team and Regulatory barrister, Charles Holland has written an article discussing the guidance and legislation surrounding the third Lockdown that has featured in The Spectator.

The article is entitled "Boris’s latest Lockdown rules are more baffling than ever" and examines how the rules and guidance vary from previous Lockdowns and the challenges faced in their enforcement.

The article highlights that in several respects, the third Lockdown is less restrictive than the first, giving examples of support and childcare bubbles and outdoor exercise with a single member of another household being permitted, as well as the significantly greater list of exemptions to the restrictions. However, Charles points out that the approach towards ensuring compliance, namely the four ‘E’s of "engage, explain, encourage, enforce", appears to have become more strict. The article concludes by questioning whether the current combination of laws, guidance and enforcement policies are the most effective mechanism to reduce social mixing and control the virus.
