Head of Trinity's Licensing team and Regulatory barrister, Charles Holland has written an article discussing the rushed Tier 4 travel restrictions that has featured in The Spectator.

The article is entitled "What does the Tier 4 law on travelling actually say?" and examines the exemptions to the stay-at-home rule in England including the implications of 'reasonable excuse'.

The article points out that whilst the new Tier 4 regulations do not contain any express restrictions on travel, essential or otherwise, they do provide for a restriction on ‘movement’ with no one living in the Tier 4 area able to leave or be outside of the place where they are living ‘without reasonable excuse’. The regulations go on to provide a list of exceptions which amount to ‘circumstances in which a person has a reasonable excuse’. The article highlights that the list is however non-exclusive on the basis that a non-listed excuse may still be regarded as reasonable depending on the specific circumstances.

Charles is instructed in a wide range of complex licensing and regulatory matters by clients from across the country and is regularly recognised by the leading industry directories, recent entries include:

"Licensing forms a large part of his broad civil practice. He predominantly acts for licensees and has substantial expertise in taxi licensing matters, as well as a broad range of licensing issues associated with music and other entertainment venues. He regularly acts in judicial reviews and appeals". “He really gets to grips with everything you give him and really drills down into the work to get you the best deal possible." Licensing Band 1, Chambers & Partners 2021.

"He has an eye for detail, is not afraid of challenging situations and has a commercial approach to clients' needs." Legal 500 2021.
