Head of Trinity's Licensing team and Regulatory barrister, Charles Holland has written an article discussing the rushed Tier 4 travel restrictions that has featured in The Spectator.
The article is entitled "What does the Tier 4 law on travelling actually say?" and examines the exemptions to the stay-at-home rule in England including the implications of 'reasonable excuse'.
The article points out that whilst the new Tier 4 regulations do not contain any express restrictions on travel, essential or otherwise, they do provide for a restriction on ‘movement’ with no one living in the Tier 4 area able to leave or be outside of the place where they are living ‘without reasonable excuse’. The regulations go on to provide a list of exceptions which amount to ‘circumstances in which a person has a reasonable excuse’. The article highlights that the list is however non-exclusive on the basis that a non-listed excuse may still be regarded as reasonable depending on the specific circumstances.
