Taking part in Chambers' 2023 Housing Law Conference in York, Trinity barrister James McHugh delivered a session entitled:
‘Have I Got Nuisance For You’ - A Practical Guide to Dealing with Prosecutions under the Environmental Protection Act 1990
Provisions under the EPA 1990 relating to private housing were previously largely used by Local Authorities as a tool to enforce compliance with minimum standards on rogue landlords. However, given the relaxed rules on cost recovery for tenants, they are now increasingly being deployed through private prosecutions by housing disrepair claims lawyers. James' talk identifies common issues and tactical considerations when dealing with these types of private prosecutions.
His session covers the following topics:
- Types of Nuisance
- Conditions
- Prejudicial to Health or a Nuisance
- Notice
- Criminal Proceedings under s.82(2) EPA 1990
- Defences
- Tactics
- Costs
