On 13 February 2026 judgment was handed down in The Imaging Centre Assets Limited v Canon Medical Systems Limited [2026] EWHC 311 (Ch), the latest round of a long-running dispute over a contract for the sale and leaseback of mobile medical scanners.
In dismissing the Claimant's application for summary judgment on liability with damages to be assessed, Master Pester accepted the arguments of Trinity Chambers' Simon Goldberg K.C. and Richard Stubbs, that the Defence raised a raft of issues which were unsuitable for summary determination. This followed an earlier hearing at which Simon and Richard had defeated the Claimant's application for urgent interim mandatory relief. The claim will now proceed to trial.
