High Court Success for Trinity Business & Property Team

A team of Business and Property barristers from Trinity Chambers led by Simon Goldberg K.C. has successfully fought off an application in the High Court for interim injunctive relief to restrain the use of allegedly confidential information. 

In Waste Managed Ltd v Wilce & others [2023] EWHC 1456 (KB) Mr Justice Murray accepted the Defendants’ submissions that: (1) the allegedly confidential information was arguably confidential only on a “sum of the parts” basis; (2) there was no serious issue to be tried as to the misuse of the allegedly confidential information; and (3) in any event the balance of convenience would have favoured the dismissal of the application having regard to the effect of the proposed relief on the Defendants’ business and the delay in making the application.

Simon Goldberg K.C. and Michael Haywood were instructed by Gibson & Co Solicitors Limited for the 1st, 4th and 6th Defendants. Paul Kerfoot was instructed by Swinburne Maddison LLP for the 2nd and 5th Defendants. Morgan Brien was instructed by Richard Reed Solicitors for the Third Defendant.

The case has now been transferred to the Business and Property Courts in Newcastle for case management and trial, reflecting the trend towards the conduct of high value litigation in the regions.
