Head of Trinity’s Business and Property Group, barrister Simon Goldberg represented the successful Claimant in Dowman Imports Ltd v 2Toobz Limited [2020] EWHC 291 (Comm).
In upholding Dowman’s claim in unjust enrichment and dismissing 2Toobz’s counterclaim for damages for breach of contract, HHJ Russen QC sitting in the Circuit Commercial Court in Bristol conducted a useful survey of the principles concerning claims for unjust enrichment based upon the provision of services in expectation of a contract which does not materialise, and the scope of the subjective devaluation defence.
