‘Mind your PCPs’ - Identifying Valid & Appropriate Provision, Criterion or Practice in Discrimination Cases.
In discrimination cases, and specifically those concerning reasonable adjustment and indirect discrimination claims, an area that is frequently problematic is the identification of a valid and appropriate provision, criterion or practice - “PCP”. Richard's talk explores the correct approach to identifying a PCP, and also highlights some common issues to avoid when dealing with these cases. The talk covers the following topics:
