Taking part in Trinity Chambers' Newcastle 2023 Business and Property Conference, Graham Bartlett delivered a session entitled:
'The Insurance Act 2015 - Avoiding a Breach of Duty of Fair Representation'
The Consumer Insurance (Disclosure and Representations) Act 2012 and the Insurance Act 2015 both sought to rebalance the rights of the insurer and the policyholder on the issues of just how much information the policyholder is required to disclose when taking out an insurance policy. The Acts also aimed to deal with the rights of an insurer to refuse to meet a claim if important information was either withheld or misrepresented to it.
In this session, Graham explores the case law leading to the Acts and their subsequent impact. His talk covers:
- The Law Prior to 2012
- Consumer Insurance (Disclosure and Representations) Act 2012
- The Insurance Act 2015
