Relief from Sanctions - James McHugh

One of the contributions at Chambers' 2024 Business & Property Court Conference held in Newcastle, included a talk by Trinity barrister, James McHugh entitled:

'Give Me Just A Little More Time' - A Look at Relief from Sanctions

In recognition of the 10th anniversary of the much cited Court of Appeal authority of Denton v. TH White Ltd [2014], which shaped the approach taken in relation to relief from sanctions applications, James discusses some of the more recent authorities governing the application of CPR 3.9 and their impact on relief applications.

James’ session explores scenarios of both successful and also unsuccessful relief from sanctions applications, including:

  • Procedure
  • Serious v Not Serious Breaches
  • Breach of Unless Orders
  • Late Claim Form
  • Late Filing of Witness Evidence
  • Unusual Name in Proceedings
  • Alleged Illness
  • IT Issues
  • Injustice of Depriving the Court of Important Evidence
  • Absence of Prejudice to the Claimant
  • Parties Benefiting from Issues Being Resolved at Trial

There is a handout that accompanies the session. If you do not have a copy and would like one, please email stevew@trinitychambers.co.uk.
