Richard Stubbs Successfully Acts for Respondent School in Resisting Post-Employment Victimisation, Harassment & Breach of Contract Claims

In Mr J Bevis v Eaton Square Schools Ltd: 2201814/2021, Trinity Chambers' Richard Stubbs successfully acted for a private school in resisting post-employment victimisation, harassment and breach of contract claims.

A former teacher alleged that him being reported for safeguarding concerns by the school, after he messaged former pupils, including commenting inappropriately on a photo post by a 14 year girl, was race discrimination.

The Claimant also alleged that he was entitled to bring the claims despite a previous COT3 between him and the Respondent settling "claims which the Claimant...may have in the future against the Respondent arising from his employment with the Respondent or its termination."

Not only were his claims dismissed but the Employment Tribunal (ET) agreed that they were unreasonable and vexatious, entitling the Respondent to costs and awarding £20,000 in costs against the Claimant; the maximum an ET can award without a full assessment of costs.

The Claimant’s subsequent application for reconsideration of the judgment was refused.
