Service of Prescribed Documents in s.21 Housing Act 1988 Possession Claims - James McHugh

Taking part in Chambers' Leeds 2024 Housing Law Conference, Trinity barrister James McHugh delivered a session entitled:
"Are You Being Served?" - Service of Prescribed Documents in s.21 Housing Act 1988 Possession Claims.

In order to bring a mandatory possession claim using s.21 Housing Act 1988, there are a number of other documents which a landlord must serve in addition to the s.21 Notice.

An increasingly common feature of s.21 possession claims is a dispute about whether those additional documents have been provided by the landlord to the tenant prior to service of the notice seeking possession. James’ talk explores the current conflict in the primary legislation, secondary legislation and case law regarding the service requirements of these additional documents.
