Sophie Johnstone Secures Community Order for Client Charged with Causing Serious Injury by Careless Driving

Trinity Criminal and Regulatory barrister, Sophie Johnstone was recently instructed by Elliott Kenton and Rowenna Allen of Weightmans Solicitors to represent an individual charged with causing serious injury by careless driving, following an incident involving serious injuries to a motorcyclist resulting in possible amputation.

The client, who was a young man, who was required to drive for his work and a caregiver to a family member, faced a lengthy custodial sentence upon the entering of a guilty plea. Weightmans, in conjunction with Miss Johnstone, prepared the case to sentence including significant mitigation materials including good character evidence and sentencing submissions.

Following submissions made by Miss Johnstone as to the sentencing parameters, the Court imposed a 12-month community order on the client, the lowest within the range afforded for culpability of this nature.

Elliott Kenton commented on the case:
“The usual outcome of these prosecutions is a custodial sentence and I am delighted by this result for our client. I was really pleased to work with Sophie on this case, who meticulously prepared and provided eloquent submissions in court. She has been integral in securing the result for the client.”
