Success for Trinity's Seth Kitson in First Tier Tribunal, Property Chamber

Following a 2-day trial in the First-Tier Tribunal Property Chamber, Land Registration Division sitting at Teesside Justice Centre, Trinity Business and Property barrister, Seth Kitson has successfully obtained a judgment dismissing the Applicant’s application for first registration of farmland based on adverse possession. 

In David William Chester vs C K and D Muir Ltd, REF/2024/0393, Seth was successful in arguing that (1) on a true construction of the underlying transfers, paper title has never vested in the Applicant, and; (2) that the Applicant could not establish either factual possession or a sufficient animus possendi to benefit from the doctrine of adverse possession.
