Taking part in Chambers' 2023 Housing Law Conference held in York, Trinity barrister Vilma Vodanovic delivered a session entitled:
‘It’s a Fair CoP’ - What Role Can The Court Of Protection Play in Housing Law Cases?
The Court of Protection has numerous powers to deal with a variety of issues concerning those who lack capacity, including issues about their property, financial affairs and welfare. Several of these powers are also relevant to housing law cases.
In this recorded session, Vilma details the role of the Court of Protection and its powers in the context of housing law from both a landlord and tenant representative's perspective. Her talk also explores the process of applying to the Court of Protection for orders that might assist in housing law cases.
Vilma's talk covers the following:
- Role of the Court of Protection (CoP)
- Definition of mental capacity
- Powers of the CoP
- Personal Welfare
- Property & Affairs
- Application to housing law
- Who can apply to the CoP?
- How to make an application to the CoP?
