Trinity Barrister at The Supreme Court

Trinity barrister, Christopher Knox appeared at the Supreme Court in a potentially significant and wide-ranging hearing relating to allegations of death by driving a motor vehicle when uninsured, disqualified and without a licence. 

The hearing was an appeal against an order of the Recorder of Newcastle HHJ Hodson and the Court of Appeal Division, R. v. H [2011] All ER (D) 135 (Jun); [2011] EWCA Crim 1508 June 17, 2011. 

The basis of the appeal was that the principles of causation should be applied in a case where the Defendant was charged with causing death by driving whilst uninsured and unlicensed pursuant to Section 3ZB of the Road Traffic Act 1988 when an allegedly drug affected, sleep deprived driver drove into him and killed himself and in circumstances where the deceased was entirely responsible for this accident. 

Christopher Knox was led by Robert Smith Q.C. The Supreme Court decision has been reserved.
