On Tuesday 24th September 2019, specialist insurance barrister, Graham Bartlett will be a guest speaker at a seminar organised by the North East Insurance Institutes.

The 2019 North East Insurance Institutes Seminar is based on a real-life case study scenario entitled:
"Fire and Fury - When disaster strikes have you really got it all covered?"

The scenario for the session opens with:
"At approximately 09:00 hrs on Saturday 1 September 2018 a serious fire breaks out within the production facility at the premises of the north's leading jam jar manufacturer...The fire quickly takes hold and causes devastation to the production hall. The adjoining offices are damaged by fire and smoke, including the main server room. Unfortunately, reviewing the fire register it becomes apparent that the production manager is unaccounted for... "

During the highly practical event, delegates will hear from experts from the profession as they work through the real-life scenario and cover all aspects of the tragic fire and its consequences.

Graham's session will explore the complexities and inter relationship between civil and criminal legal liabilities generated by the case study. He will examine the sums payable to the deceased production manager’s estate and his dependants, focusing on potential professional negligence claims against the brokers and loss adjusters. He will also cover the existence of some form of warranty which the policyholder alleges that the brokers failed to advise them of and the insurers rely on breach of to reject the claim. He will further address the potential professional negligence of loss adjusters in investigating and adjusting the loss. Graham's session will help delegates' understanding of:

  • Damages under the Law Reform (Miscellaneous Provisions Act) 1934 and Fatal Accident Act 1976.
  • Professional Negligence: the meaning of ‘professional’ and the standard of care and skill required.
  • Professional Negligence: assessing damages for the loss of an uncertain outcome.

Graham’s practice is focused on insurance related litigation following his career as a Chartered Loss Adjuster. He is therefore able to provide practical and pragmatic insight in cases involving all aspects of insurance disputes. He also deals with building and construction disputes involving damage to both residential and commercial property, as well as claims under the insurance clauses in the JCT Standard Form of Building Contract and on Contractors All Risks insurance policies.
