On Monday 9th May members of Trinity Chambers' Employment groupSimon Goldberg and Richard Stubbs, will be commencing the test case on whether the NHS has a “Genuine Material Factor” defence to the equal pay claims brought by women in the NHS. The case is listed for seven weeks at the Newcastle Employment Tribunal and will test the defence that separate collective bargaining processes as between the predominantly female and predominantly male groups provides a substantive defence to the unequal pay as between the female Claimant and the male comparator.
