Judgment has been handed down by Lord Justice Maurice Kay (Vice President of the Court of Appeal, Civil Division) in Brownbill v St Helens & Knowsley Teaching Hospitals NHS Trust - 2011 EWCA Civ 903 in which Trinity barrister Richard Stubbs, led by Karon Monaghan QC, successfully resisted the appeal of the NHS Trust against the decision of Cox J in the EAT that unsocial hour enhancements were a separate term to basic pay for the purposes of an equal pay claim.
The case is another significant Equal Pay matter that a barrister from Trinity Chambers' Employment Group has been involved with. Whilst the Employment Law Group operate from Trinity's chambers in Newcastle and Middlesbrough, the barristers have substantial experience of dealing with Equal Pay issues nationwide, including hearings in Scotland.
