In Corby v ACAS (Case: 1805305/2022), Trinity Employment Law specialist Antoine Tinnion successfully defended ACAS against a claim in the Leeds Employment Tribunal of 'philosophical belief' discrimination brought by a former employee under the Equality Act 2010.
At a preliminary hearing in 2023, the ET held that the Claimant's beliefs about 'Critical Race Theory' were protected philosophical beliefs.
Following a trial in April 2024, however, the ET held that the Claimant had not been subject to direct discrimination or harassment because of those beliefs (a claim of victimisation was dismissed on withdrawal).
