Head of Trinity's Licensing team and Regulatory barrister, Charles Holland's recent article focusing on an omission in the new Health Protection (Coronavirus, Restrictions) (All Tiers) (England) Regulations 2020 (“the All Tiers Regulations”) has been featured in Local Government Lawyer.
The article is entitled "All Reasonable Measures: tidying up the Coronavirus, Restrictions Regulations and the law of unintended consequences". Charles examines how an amendment in the All Tiers Regulations and the deletion of the "all reasonable measures" has removed an important obligation on the operators of a significant class of premises in Tier 3.
In the article, which can be found here, Charles suggests that the removal of the obligation must have been an unintended consequence of the amendment and argues that it should be reversed to plug what now is a significant and unjustified loophole in the regulatory provisions.
