Trinity's Fraser Williamson Advises on UK Anti-Doping (UKAD) Matter

Trinity Sports Law and Regulatory barrister Fraser Williamson has advised in relation to a matter involving a sporting participant under the UK Anti-Doping Rules.

Fraser was instructed on behalf of the Respondent in connection with proceedings brought by UK Anti-Doping (UKAD), advising on both the substantive and procedural aspects of the case within the results management framework.

The matter involved consideration of an alleged Anti-Doping Rule Violation under Article 2.7 of the UK Anti-Doping Rules (trafficking or attempted trafficking of a prohibited substance), together with the applicable sanctioning provisions under Article 10. Advice was provided in respect of the structure of the Rules, the applicable minimum period of Ineligibility, and the factors relevant to determining the appropriate position within the prescribed range.

In particular, Fraser advised on the operation of Article 10.8.1, which provides for a mandatory reduction in sanction where a respondent admits the violation and accepts the asserted consequences within the prescribed timeframe. This included strategic advice on the timing and scope of any admission, as well as the legal effect of such an election on appeal rights and further reductions under the Rules.

Further advice was provided in relation to the preparation and presentation of mitigation, including the relevance of early admissions, cooperation with the results management process, personal mitigation, and the overarching requirement of proportionality in sanctioning. Consideration was also given to the interaction between the UKAD process and parallel proceedings, and the extent to which such matters may properly inform sanction.

The matter also involved advice on the potential engagement of Article 10.8.2, concerning Case Resolution Agreements, including the circumstances in which such a resolution may be appropriate and the procedural framework governing without prejudice discussions with UKAD and the World Anti-Doping Agency (WADA).

Fraser’s involvement encompassed strategic advice throughout, together with detailed input into the preparation of written mitigation and the navigation of the regulatory framework governing anti-doping proceedings.
