Trinity's Seth Kitson acted for the successful Defendants in the matter of A v B & A.
Seth was instructed on behalf of the Defendant Trustees in a CPR 64 claim under which the Claimants sought orders compelling the trustees to make certain distributions from a trust fund and for the removal of the trustees. The subject matter of the trust was the proceeds of a substantial insurance policy which had paid out on the unexpected death of the settlor. The Claimants were a child of the settlor as well as the settlor’s estate.
Seth was successful in obtaining a strike-out order against the Estate on the grounds that they lacked standing to bring the claim. At trial held on 30 June 2026 at the County Court at Leeds, Seth was successful in arguing that (i) there had been no error of discretion by the trustees; (ii) the Court ought not to interfere with a proper exercise of discretion, and; (iii) accordingly, there was no proper ground for the removal of the trustees.
The claim was dismissed by District Judge Royle, sitting in the County Court at Leeds at the conclusion of the trial.
