Head of Trinity Chambers’ Business and Property team, Simon Goldberg K.C. leading Abigail Cheetham represented a former Newcastle United football player in proceedings in the High Court at Manchester.
In Papiss Demba Cisse v Sandra Diene & Madou Diene [2024] EWHC 1717 (Ch), HHJ Halliwell set aside a Declaration of Trust which had provided sole beneficial ownership of two properties to Mr Cissé’s former agent on the basis of undue influence.
Additionally, the Court ordered the Second Defendant to provide an account of all transactions made from Mr Cissé’s bank accounts whilst he acted as his agent due to his wilful default. The Defendants were further ordered to provide an account of rent and profits obtained from renting out a property, which the Court found to be owned by Mr Cissé.
A consequential hearing will be held to determine the outstanding matters of injunctive relief, directions for the accounts to be provided and costs.
