Update on Part 36 Offers - James McHugh

Speaking at Chambers' Newcastle 2023 Business and Property Conference, Trinity barrister James McHugh delivered a session entitled:
'Settlers Beware' - Update on Part 36 Offers

Part 36 Offers are a useful weapon in the litigator's armoury to protect the position of clients and also to try and exert pressure on opponents to engage in meaningful settlement discussions.

In this talk, James highlights some important and interesting recent cases to help refine and improve litigators' tactical approach when making and/or accepting Part 36 offers. The judgments referred to by James go beyond the Personal Injury jurisdiction and will have wider consequences that Business & Property litigators ought to bear in mind when approaching settlement using Part 36.

  • Akinola v. Oyadare and Another
  • Gohill v. Advantage Insurance Company Ltd
