Whistleblowing: Who is Protected? - Richard Stubbs

At Chambers' recent Employment Law Conference, Trinity's Richard Stubbs delivered a session entitled:

‘Whistleblowing: Who is Protected?’

Richard’s talk examines the scope of whistleblowing protection and the evolving question of who qualifies for protection under the Employment Rights Act 1996. The session gives an overview of the current framework introduced by the Public Interest Disclosure Act 1998 and considers how recent case law has broadened the scope of “limb (b)” workers under section 230 ERA, showing protection can extend beyond the categories suggested in government guidance and highlighting ongoing uncertainty about where the legal boundary is drawn.

  • Current statutory requirements for making a protected disclosure
  • Who qualifies for protection and the scope of “worker” status
  • Recent case law on limb (b) workers
  • Possible future developments, including the Office of the Whistleblower Bill
