James Marwick

James is an experienced litigator having practised both at the bar and in private practice before that, with extensive spells spent with two prominent offshore law firms in Jersey and Guernsey.


Personal Injury & Costs

James is regularly instructed on multi-track claimant and defendant personal injury claims with a particular focus on industrial disease (including NIHL, Respiratory and Vibration claims), occupier’s liability claims, road traffic cases (with a particular expertise in dealing with fraudulent claims) and claims involving the Court of Protection. He is always willing to consider acting on a CFA basis and has a significant advisory and drafting practice, including dealing with and settling personal injury trusts. Regularly instructed to attend CCMCs and to deal with all elements of costs budgeting, as well as wider costs matters, including detailed and provisional assessments, both PI and non-PI related.


James has a particular interest in all matters relating to village greens, parks and open spaces. James is regularly instructed by local authorities to act as an independent inspector in relation to village green applications. He contributes to Westlaw as its village green insight author and regularly deals with matters relating to land ownership, registration and possession. He is frequently instructed by local authorities and parish councils in relation to the management of their land, including advisory and court work in relation to injunctions against trespassers and travellers, adverse possession claims and planning matters where he has extensive experience of dealing with CPOs. Regular instructions also include wider Chancery matters including cases with a trusts element where James draws upon his significant experience of trusts litigation in Jersey and Guernsey.

Commercial & Business

James undertakes wider commercial litigation, including professional negligence, contractual and insurance matters, together with consumer credit related cases, where he has acted frequently in relation to financial mis-selling litigation.
